Abstract

Parenthood is an irreplaceable experience for many women and has an honoured place in their hearts. It is regarded as a magical and satisfying process to have children, bear a child in the uterus, and then give birth to an infant. However, due to different medical illnesses, reproductive challenges, or other factors, some females are endowed with the capacity to have a child. Surrogacy has become a realistic choice to satisfy their maternal goals. Surrogacy enables women unable to have children or carry a kid within their uterus to have offspring. It has given women who have conquered obstacles in achieving their parenthood ambitions optimism and a ray of sunshine. It is a chance to experience the joy of parenting and a blessing for individuals unable to get pregnant traditionally. This research paper aims to analyse the practice of surrogacy in India critically by underlining the concept, legality & constitutionality and how procreative tourism is a controversial ethical issue in India.
